JUSTICE 4 LIMITED – No Win No Fee Compensation

Athena law is now representing consumers who have been let down by Justice 4 Limited (“J4”).

In the past weeks Athena has recovered full compensation for consumers who paid Justice 4 to act for them in pursuing claims on their behalf in Spain.

The background

J4 was a company based in Bridgend in Wales, being incorporated on 15th August 2013.

J4 was one of the first companies in the UK to offer clients a claims management service to recover compensation from the Courts in Spain for alleged mis-selling of timeshares.

The service purportedly offered by J4 was to manage clients claims in Spain, including:

  1. Reviewing relevant documents.

  2. Briefing Spanish Lawyers.

  3. Paying Spanish Lawyers and court costs for pursuing claims in Spain.

  4. Arranging Translations.

  5. Arranging notarisation of key documents.

  6. Liaising with the Spanish Lawyers and the clients, and doing all to manage clients claims through the Spanish legal system.

Typically, J4 asked clients to pay them on account for the cost of Spanish Lawyers. J4 would then be paid a percentage of the damages for their management services if the claim was successful.

On 17th October 2017 J4 went into liquidation, owing creditors more than £850,000.

Following the Liquidation there have been many complaints that claims in Spain have not been progressed. Spanish lawyers have not been paid. Nothing has happened, and J4 clients cannot recover the upfront fees that they have paid, leaving them in a position whereby they either have to pay yet more money to progress their claims, or not pursue what may be valid claims.

The case

Athena Law are acting for several former clients of J4. In each case claims in Spain have not been progressed. It is clear from the papers that we have reviewed on behalf of each of these clients, and enquiries of lawyers in Spain that:

  1. J4 were paid money upfront to issue claims in Spain (in some cases more than 3 years ago).

  2. J4 did not pay the Lawyers in Spain, despite having received a favourable opinion from lawyers and being issued with an invoice.

  3. Claims have accordingly not been progressed.

  4. J4 were charging on average 3 x the cost of the Spanish Lawyers thereby making a secret profit.

In the face of a liquidation and J4’s last filed accounts there would normally be little prospect of financial recovery, leaving many in limbo with their claims. Fortunately, if you paid J4 a deposit by credit card there is hope. Athena Law are bringing claims against credit card providers pursuant to section 75 of the Consumer Credit Act, whereby credit card providers will be jointly and severally liable subject to the clients proving misrepresentation and/or breach of contract. Th claim will be for the following:

  1. Full refund of ALL money paid to J4, plus

  2. Interest at 7% per annum.

In order to succeed in these claims, clients will have to set out in detail the misrepresentations and breach of contract, identifying (and proving) the key representations and contractual terms and proving that and representations were in law misrepresentations or that there were breaches of contract.

Athena Law is pleased to announce that in the last two weeks it has recovered a combined £45,000 for two of its clients. It is anticipated that more settlements will follow. These clients will therefore be compensated and Athena, as part of the service will review their historic timeshare claims and give advice as to whether or not they have claims, and what options they have for pursuing such claims.
